US abortion: Iowa’s top court upholds six-week abortion ban law


Iowa’s highest courtroom has upheld a regulation saying the state can implement a ban on most abortions after about six weeks of being pregnant.

The regulation bans abortions after early indicators of cardiac exercise could be detected in a foetus or embryo – however makes exceptions for instances of rape, incest, foetal abnormalities and when the mom’s life is in peril.

The choice made on Friday reverses a temporary block of the law, which was initially handed by the state legislature in July 2023.

The Iowa Supreme Courtroom rejected the lawsuit by Deliberate Parenthood, in a 4-3 ruling which held that the regulation doesn’t violate residents’ elementary rights below the state structure.

The choice, revealed on the courtroom’s web site, held that legal guidelines limiting abortion had been solely unconstitutional if the state can’t present a “rational foundation” for the regulation.

Justice Matthew McDermott wrote within the majority opinion that the regulation was “rationally associated to the state’s respectable curiosity in defending unborn life”.

Chief Justice Susan Christensen wrote in her dissenting view that almost all “strips Iowa girls of their bodily autonomy” and depends closely on “the male-dominated historical past and traditions of the 1800s”, whereas ignoring the progress made in girls’s rights since then.

Iowa Governor Kim Reynolds – who initially signed the 2023 regulation – welcomed the choice in an announcement.
